The recordal of intellectual properties to the Customs is a procedure for holders of intellectual properties to record the rights of their intellectual properties (including trademarks, patents and copyrights) with the database of the Customs, in order to obtain protection and quick action from the Customs, while infringing goods are found.
According to the Regulations on Customs Protection of Intellectual Property Rights of the PRC , after the record is made, an intellectual property right holder could request Customs to detain goods suspected of infringement, when he/she find any infringing goods are about to be imported or exported. If those detained goods are infringement upon investigation by the customs, those infringing goods shall be confiscated by the customs.
